Terms and Conditions
These regulations define the rules for making purchases in the online store operated by the Seller at www.grappzilla.com.
The Seller is the company GrappZilla based in Warsaw at Bluszczańska 69b/42, registered under Tax Identification Number (NIP) 7411893693, National Official Business Register (REGON) 141158520, also interchangeably referred to as the "Service Provider".

1 Definitions
Regulations - these regulations. In terms of services provided electronically, the Regulations are the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204, as amended);
Customer (Buyer) - a natural person who purchases products or services offered by the store by placing an order through the store's website. The Customer is the entity that enters into a legal relationship with the store owner and uses the services offered by the store in accordance with applicable laws, including sales contracts and other related regulations.
Entrepreneur on consumer terms - a natural person concluding a contract directly related to their business activity when it results from the contract that it does not have a professional character for them, arising in particular from the subject of their business activity made available based on the provisions of the Central Register and Information on Economic Activity;
Subject of the transaction - Goods listed and described on the website of the Online Store. The Seller makes every effort to ensure that the presented offer on the pages is up to date. However, if some of the Ordered Goods are unavailable, the Seller undertakes to immediately inform the Buyer about the situation by phone or email;
Goods - a movable item covered by the Sales Agreement;
Additional Service - a service provided by the Service Provider to the Customer outside the Online Store in connection with the nature of the sold products;
Product - Goods and Additional Services presented in the Online Store;
Sales Agreement - a contract for the sale of Products within the meaning of the Civil Code, concluded between the Service Provider and the Customer, using means of distance communication (including by phone);
Online Store - an internet service available at www.grappzilla.com, through which the Customer can purchase the Product;
Party - Service Provider and Customer;
Store Page - any web page or subpage located at www.grappzilla.com;
Order - the Customer's declaration of will unambiguously specifying the type and quantity of Products, aimed directly at concluding a Distance Sales Agreement through the Online Store;
2 General principles
The condition for placing an Order in the Online Store by the Buyer is familiarization with these Regulations and acceptance of its provisions during the Order fulfillment;
The online store www.grappzilla.com conducts retail and wholesale sales via the Internet;
All products offered in the store www.grappzilla.com are brand new, originally packed, free from physical and legal defects, and have been legally introduced to the Polish market;
The Online Store enables access to product reviews from Customers who have purchased them. After placing an order and its receipt, the Customer receives an email requesting a product review. Individuals who have not purchased a specific product in the Store do not have the option to provide a review;
3 Placing orders
All prices on the websites www.grappzilla.com are gross prices (including VAT) stated in Polish zloty or euros. The prices indicated do not include shipping costs;
Orders are accepted through the website;
Orders placed through the website can be made 24 hours a day, 7 days a week, throughout the year;
The Order is effective if the Buyer correctly completes the order form and provides accurate contact details, including the precise address to which the goods are to be sent, as well as a telephone number and email address;
If the above data is incomplete, the Seller will contact the Buyer. If contact with the Buyer is not possible, the Seller has the right to cancel the order;
The Buyer consents to the issuance and transmission of electronic images of settlement documents by electronic means to the email address specified by them;
While placing an order, the Buyer may consent to the placement of personal data in the database of the Seller's Online Store for processing in connection with Order fulfillment. If consent is given, the Buyer has the right to access their data, edit it, and request its deletion;
After placing an order, the customer will receive an automatic email from the store system confirming receipt and changes in the order fulfillment status;
The time for commencing the order fulfillment is counted from the moment the money is credited to the store's bank account specified in the order confirmation message in the case of choosing the bank transfer option or from the moment of placing the order in the case of choosing payment by electronic payment system, card payment, or "cash on delivery";
To facilitate the selection of the appropriate size of the product by the Customer, a size chart has been placed on the individual product pages. However, it is purely indicative and in some cases may slightly differ from the actual sizes.
4 Shipping costs and terms
The goods are sent to the address details provided in the order form;
The prices of products on the store's website do not include transportation costs. The Buyer must additionally add them to the product price;
All information regarding the shipment of goods to the customer, including: shipping terms, delivery costs, and estimated delivery time, is provided on the store's website in the "Product Shipping" section;
The estimated delivery time provided in the "Product Shipping" section on the store's website applies to cash on delivery shipments. When choosing the bank transfer payment option, the estimated delivery time is extended by the time it takes for the store to receive the transfer. Usually, this takes 1-2 business days. In the case of card payments or payments through an electronic payment system, the delivery time is extended by the time it takes for the store to receive information from Przelewy24 about payment acceptance. Usually, this takes a few minutes after the customer finalizes the payment.
5 Payments
We issue a receipt or a VAT invoice (at the customer's request) for all products purchased in the store;
Permissible payment methods in the store are: transfer, card payment, transfer using an electronic payment platform, and cash on delivery;
For some products, we reserve the right to limit selected payment methods for a given item;
From January 1, 2020, a buyer who, in connection with their business activity, wants to receive a VAT invoice should inform the seller at the time of purchase by selecting the "I want to receive a VAT invoice" option. After registering the sale on the fiscal cash register, it will not be possible to issue an invoice at a later date.
6 Receipt of goods
Deliveries are made by the store within Poland and European Union countries;
Details regarding shipping packages abroad are described on the store's website in the "Product Shipping" section;
Before accepting the shipment from the courier or at the post office, it is necessary to check if the package is not damaged, the packaging is not torn, or the securing tapes have not been torn. In such a case, the package should not be accepted, and a protocol of damage should be drawn up in the presence of the courier, post office employee, or mailman, and contact with the store's customer service should be made as soon as possible. Failure to detect irregularities in accepting the shipment by the customer may negatively affect the outcome of the customer's claims for damage or theft of the shipment during transport.
7 Withdrawal from the contract
The consumer has the right to withdraw from the contract without giving a reason within 14 days of receiving the shipment. This right is defined in Article 7(1) of the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product Journal of Laws No. 22, item 271, as amended.
Entrepreneurs on consumer terms have the right to withdraw from the contract without giving a reason within 14 days of receiving the shipment. The rest of the provisions of these regulations regarding consumers' rights to withdraw from the contract apply accordingly to entrepreneurs on consumer terms;
In the event of withdrawal from the contract, it is necessary to inform the store in writing. In the case of returning the purchased goods, it is necessary to attach a returns form, which can be downloaded from the store's website in the "Returns and Complaints" section;
The company reserves the right to refuse order fulfillment in special cases, e.g., entering an incorrect price for the goods due to technical errors;
The returned goods in this mode will be accepted only if the Customer returns it in a fully complete condition, including the product, and the packaging does not show signs of use and is undamaged;
According to Article 34(4) of the Consumer Rights Act, "the consumer is liable for the reduction in the value of the thing resulting from using it in a way that goes beyond what is necessary to determine the nature, characteristics, and functioning of the thing." Thus, the store reserves the right to reduce the amount refunded to the Customer if the returned goods, including the packaging, arrive at the store in a condition indicating their use and preventing further sale at the original price. The same applies to entrepreneurs on consumer terms;
In the case of withdrawal from the contract, the returned goods should be sent at the customer's expense to the Service Provider's address - this address is provided on the store's website in the "Returns and Complaints" section;
The shipment must include the printed returns and exchanges form, which is available for download from the store's website in the "Returns and Complaints" section. If it is not possible to print the form, a written statement is sufficient. The statement should include the account number to which the store should refund the payment for the goods;
The consumer has the option of returning the shipment through a selected courier company or may use the "Fast Returns" procedure – details are described on the Online Store's website in the Returns and Complaints section;
The store will refund the cost of the goods within 14 days from the date of receiving the shipment;
According to Article 33 of the Consumer Rights Act, if the consumer has chosen a method of delivering the item other than the cheapest standard delivery method offered by our store, the costs of delivering the item in accordance with the cheapest delivery option in our offer will be refunded. The same applies to entrepreneurs on consumer terms;
According to Article 38 of the Consumer Rights Act, the right to withdraw from a distance contract is excluded if the subject of the performance is a thing delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery. The same applies to entrepreneurs on consumer terms;
In accordance with the Guidelines of the Directorate-General for Justice on the directive of the European Parliament and of the Council 2011/83/EU of 25 October 2011 on consumer rights when purchasing a promotional set, we do not accept returns of individual elements included in the set;
All the above rules, if not clearly stated by the provisions of the law (Consumer Rights Act, etc.), apply only when making purchases on the www.grappzilla.com website. In the case of purchasing our products on external sales services and platforms (e.g., Allegro, Ceneo, etc.), the consumer is obliged to adhere to the return deadlines and rules that apply on these platforms.
8 Complaint Procedure
In the event of non-conformity of the goods with the contract in a product purchased from the Online Store, the Customer and the Entrepreneur, acting as a consumer within the meaning of the Act of May 30, 2014 on Consumer Rights:
The product should be returned at the Customer's own expense to the store address provided in the "Returns and Complaints" section on the store's website. Following a positive decision regarding the consideration of the complaint issued within 14 days, the store will refund the Customer or the Entrepreneur, acting as a consumer, the costs of shipping the goods to the store.
The repaired product is sent back to the Customer or the Entrepreneur, acting as a consumer, at the store's expense. In the event that the product is not suitable for repair, the store will exchange the product for a new one for the Customer or the Entrepreneur, acting as a consumer. If such a product is not available at that time, the store will refund the Customer or the Entrepreneur, acting as a consumer, the purchase costs of the product along with the full shipping costs incurred by the Customer in purchasing and returning the product.
In the event of non-conformity of the goods with the contract, the complained goods, along with a letter specifying the type of non-conformity and expectations regarding the way we fulfill our obligations, should be returned to the store address provided in the "Returns and Complaints" section on the store's website. The store will refund the Customer the delivery costs of the goods to the store. The legal basis in this case is the Act of May 30, 2014 on Consumer Rights. The same applies to Entrepreneurs acting as consumers.
The Customer will lose their rights specified in the legal provisions referred to in point 4 if, before the expiry of two months from the determination of the non-conformity of the goods with the contract, they do not notify the store of this fact. Sending the notification before its expiry is sufficient to meet the deadline. In the case of sales not constituting consumer sales, the provisions contained in Articles 556-576 of the Civil Code do not apply. The same applies to Entrepreneurs acting as consumers.
9 Placing Offers
Offers presented to the Customer and Entrepreneurs acting as consumers within the scope of internet search results are placed based on the parameter of matching the phrase entered in the search engine to the product name in the store's offer. Compared to others, this parameter allows presenting search results more accurately corresponding to the consumer's preferences.
10 Personal Data Protection
We inform you that GrappZilla company adheres to the applicable principles of personal data protection arising from current legal regulations, especially the General Data Protection Regulation (GDPR) in force throughout the European Union. Details regarding the protection of your personal data can be found in our Privacy Policy.
11 Final Provisions
Matters not regulated by this regulation are subject to the provisions of the Act of May 30, 2014 on Consumer Rights and the Civil Code.
Disputes arising from the application of this regulation and in connection with the performance of contracts concluded between the store and customers or Entrepreneurs acting as consumers will be considered by the court having jurisdiction under the substantive and local jurisdiction regulations in accordance with the Act of November 17, 1964, the Code of Civil Procedure (Journal of Laws No. 43, item 296, as amended).
The Service Provider reserves the right to introduce changes to this regulation; however, the version of the Regulation valid at the time of placing the order by the customer applies to agreements concluded before the change of the Regulation.
